First Nation fights province over smoking

Brokenhead Ojibway Nation is challenging the provincial government over its smoking ban.

The band council of the First Nation north of Winnipeg on Highway 59 filed a statement of claim in the Court of Queen’s Bench on Monday to argue that the NDP government does not have authority to impose smoke bans on reserves.

Brokenhead wants to move its existing video lottery lounge from the current location at the community hall east of Highway 59, where smoking is allowed, to an expanded site across the highway, which has been ready since October. However, to grant the new lounge 20 more VLTs, which would increase the number to 60, the province wants the new gaming room to go smoke free.
